Receiving subpoenas in the County Clerks office should be handled according to the following:
- Subpoena is addressed to TN Dept. of Revenue and/or Vehicle Services - If a County Clerk's office receives a subpoena addressed to the Tennessee Department of Revenue (the "Department"), please immediately scan and send an electronic version of the document via email to VehicleServices.Research@tn.gov. In this situation, please do not produce any requested documentation, as this will be handled by the Department's Legal Office. Responding to a subpoena without consulting the Legal Office can put the county office/employee and the Department at risk. The Department's Legal Division will ensure that the subpoena was properly issued and that the response is accurate and complete.
- Subpoena is addressed to the County - If a County Clerk's office receives a subpoena for motor vehicle records that is addressed directly to the county, the county may choose to respond directly and provide documentation from the VTRS database. However, the Department advises the counties to follow the procedure above and forward the subpoena to the Department, as the Department's Legal Office will ensure that the subpoena was properly issued and that the response is accurate and complete.
